Citibank Denied Your Debit Card Dispute: What Happens Next?

A denied Citibank dispute can leave you paying for a transaction you say you never authorized. You may have already called, submitted documents, and explained the same events more than once.

Before sending another appeal, look closely at the reason Citi gave. A useful next step is to compare that reason with the evidence and the rules governing your specific transaction. A debit card case, a credit card billing dispute, and a traditional wire-transfer dispute do not all follow the same legal framework.

This article concerns consumer deposit accounts and potentially covered electronic transfers. Request a review of your Citibank dispute if you need help identifying the applicable rules.

Was this a debit card charge or a credit card charge?

If the disputed transaction removed money from your checking account through your debit card, the Electronic Fund Transfer Act and Regulation E may apply. The same may be true of certain ATM, ACH, and online transfers.

A Citi credit card billing dispute requires a different analysis. Likewise, the fact that a transaction was performed online does not automatically bring a traditional wire within Regulation E. Preserve the statement and transaction description so an attorney can identify the payment method. Regulation E’s coverage rules.

Turn the denial into specific questions

Instead of simply stating that Citi’s decision is wrong, identify what the decision leaves unanswered:

  • What evidence did Citi rely on to find authorization?
  • Did the explanation address the account compromise you reported?
  • Were all the transactions in your original report investigated?
  • Did the bank provide a written explanation and access to the documents supporting its findings?
  • If a temporary credit was removed, what notice accompanied the reversal?

A denial alone does not prove a legal violation. The underlying record can show whether the conclusion and the process deserve further review.

Preserve the first report, not just the final appeal

Download the statement showing the transfer and the confirmation of your first dispute. Keep later appeal submissions in date order. If you reported the error by telephone, note the date, approximate time, telephone number used, and any reference number.

For ordinary covered accounts, the error-resolution notice period generally runs from the statement first showing the error. Report immediately; waiting can also affect liability for unauthorized transfers. A lawyer should assess the actual dates rather than assuming the latest appeal controls. Regulation E’s notice requirements.

Does Citibank pay arbitration fees?

The consumer deposit agreement reviewed for this article provides for AAA arbitration. For disputes of $74,000 or less unrelated to debt collection, Citi agrees to pay the customer’s share of arbitration fees. That is a contractual payment provision, not a requirement that you first win your case. Citi’s consumer deposit agreement, “Paying for Arbitration Fees”.

The agreement separately addresses attorney fees and arbitration appeals. Your attorney should confirm the applicable agreement and payment arrangements. Do not assume that the deposit-account clause applies to a Citi credit card or that every possible expense is covered.

What could a successful EFTA claim recover?

Depending on the violation and evidence, relief can include actual damages, statutory damages, and reasonable attorney fees and costs. Individual statutory damages under the EFTA generally range from $100 to $1,000; they are not an automatic $1,000 award for each disputed transaction. 15 U.S.C. §1693m.

Have an attorney examine your Citi dispute

A productive review starts with the disputed amount, the original report, and Citi’s explanation. Ask Bank Dispute Law to review your Citibank denial and explain whether the transaction and investigation support a claim.
