Wells Fargo denied your fraud claim? What to do next
If Wells Fargo denied your personal-account fraud claim, save the denial, your first dispute report, and the disputed account entries. Request the written findings and the documents used to make the decision. A lawyer can compare that explanation with your evidence and assess whether the handling of the claim supports further action.
This article addresses consumer electronic-transfer disputes. Credit-card billing complaints, paper checks, business accounts, and some wire transfers may involve different rules. Identify the transaction before choosing a dispute procedure.
What the written response must include for a covered claim
When the institution determines that no error or a different error occurred, Regulation E, § 1005.11(d)(1) requires a written explanation of its findings and notice of the consumer’s right to request the documents relied on. Requested documents must be supplied promptly.
Wells Fargo’s consumer debit and ATM card terms also describe written explanations and access to investigation documents. Save the terms applicable to your account. This duty does not mean that every denial must include every record without a request or take the form of a lengthy legal opinion.
Turn a general denial into factual questions
- Which transactions did Wells Fargo investigate, and were any omitted?
- What facts support its conclusion about authorization?
- Did it consider the account-access or lost-card information you supplied?
- Does the response use a merchant receipt, device record, or transaction code that needs explanation?
- Does its timeline match the date of your first error report?
Keep your questions tied to the records. If you supplied a message showing an unauthorized phone-number change, identify the date you sent it and ask how that fact fits the decision. If you do not know how someone accessed the account, say that instead of proposing a theory as fact.
A correct credential is not the whole authorization question
A transaction can be technically authenticated without settling whether the person initiating it had actual authority. The CFPB’s electronic-transfer guidance discusses fraudsters initiating payments with credentials obtained through deception. That differs from a consumer personally initiating a payment to a dishonest recipient.
Explain who performed each step. Evidence that a card, PIN, or phone was used needs to be assessed alongside your account of access, permission, and any benefit from the transfer. Do not assume that all scam losses fall within the same definition of an unauthorized transfer.
Build a short, useful follow-up
Regarding claim [number], please send the written findings and the documents relied on in making the determination. My dispute concerns [dates and amounts]. Please address this factual discrepancy: [brief description supported by your records].
Send it through a verified contact route identified by the bank or the decision notice. Wells Fargo’s fraud-reporting page directs customers to report suspected unauthorized card activity promptly using the number on the card. Keep the response and proof of delivery; a social-media complaint is not a substitute for a properly directed dispute.
Know when another internal appeal may not help
Regulation E does not require endless reinvestigation of the same error after an institution has fully complied with the applicable procedures. Its reassertion provision makes the handling of the original claim important. A new appeal is not a reliable way to restart deadlines.
If the documents fail to address your report, a credit was reversed, or the response conflicts with your records, request a free case review. Have the first report, denial, decision documents, and account entries available. An attorney can evaluate the investigation and notice issues as well as the transfer itself.
Questions after a Wells Fargo fraud denial
Can a lawyer help if Wells Fargo says I authorized the transaction?
A lawyer can review the evidence supporting that conclusion and your explanation of who initiated the payment. Save device alerts, login changes, support messages, and any records showing a lost phone or account takeover. Read more about a bank saying a transfer was authorized.
What if Wells Fargo took back the provisional credit?
Save the reversal notice and the account entries showing the temporary credit, its removal, and any fees. Our Wells Fargo provisional-credit reversal guide explains what to gather for review.
Does a denied fraud claim mean I can win a lawsuit?
No. The transaction, reporting dates, investigation, applicable law, and account agreement must be reviewed. The initial review determines whether further assistance may be appropriate.
General information, not legal advice. Account terms and facts matter. Bank Dispute Law is independent of the institutions discussed. An inquiry does not create an attorney-client relationship.
